1. About These Terms
These Terms & Conditions govern all services provided by Dunwoodie Diesel & Mechanical (“DDM”, “we”, “our”, or “us”) to our customers (“you” or “the customer”).
By requesting a quotation, booking a service, approving repair work, or engaging DDM to carry out any work, you acknowledge that you have read and accepted these Terms & Conditions.
These Terms are designed to ensure clear communication, fair business practices, and a professional working relationship between DDM and our customers.
Where applicable, these Terms operate alongside the Australian Consumer Law and do not exclude or limit any rights that cannot legally be excluded.
2. Scope of Services
DDM provides professional mobile heavy diesel mechanical services including, but not limited to:
Heavy vehicle servicing and repairs
Truck diagnostics and fault finding
Earthmoving and plant equipment repairs
Mobile preventative maintenance
Breakdown assistance
Hydraulic and mechanical component replacement
Electrical fault diagnosis and repairs
Fleet maintenance
Mechanical inspections
Scheduled servicing
Services are primarily provided on-site throughout Perth and surrounding areas unless otherwise agreed.
DDM reserves the right to decline any work that is considered unsafe, outside our expertise, beyond available resources, or likely to create an unacceptable safety or commercial risk.
3. Quotations & Estimates
Unless otherwise stated, all quotations remain valid for thirty (30) days from the date issued.
Quotations are based on the information available at the time and may require amendment if additional faults, hidden damage, or unforeseen circumstances are identified during repairs.
Where practical, DDM will seek customer approval before undertaking additional chargeable work beyond the original quotation.
Verbal quotations and estimates are provided as a guide only and do not constitute a fixed price unless confirmed in writing.
Any variation to the agreed scope of work may result in additional labour, parts, travel, freight or consumable charges.
4. Approval to Commence Work
Approval to proceed with repairs may be provided by:
Signed quotation
Email confirmation
SMS or text message
Approval through ServiceM8
Verbal approval where immediate action is required
Once approval has been received, DDM is authorised to commence work and order any necessary parts or materials.
If special-order parts are required, these may need to be paid in full before ordering.
The customer acknowledges that diagnostic work is chargeable regardless of whether repairs proceed or whether a fault can ultimately be rectified.
5. Professional Standards
DDM is committed to providing reliable, high-quality workmanship while maintaining professional standards on every job.
Unless site conditions prevent it, every service will include:
Professional diagnosis
Work completed to industry standards
Appropriate replacement parts and materials
Digital service records where applicable
Photographic documentation where appropriate
Recommendations for any additional defects identified during inspection
Our objective is not simply to repair equipment, but to help customers minimise downtime through reliable workmanship, honest communication and preventative maintenance advice.
6. Labour, Travel & Call-Out Charges
Labour Charges
DDM’s labour rates are based on the type of equipment being serviced and the complexity of the work involved.
Current labour rates are available upon request or will be specified within your quotation or ServiceM8 estimate.
Labour is charged from the time the technician commences work until the work is completed, unless otherwise agreed in writing.
Labour charges include, but are not limited to:
Fault diagnosis
Mechanical repairs
Scheduled servicing
Preventative maintenance
Component replacement
Electrical diagnostics
Hydraulic repairs
Testing and commissioning
Job documentation and reporting
All labour is billed in accordance with the agreed hourly rate applicable at the time the work is performed.
7. Minimum Charges
To ensure the costs associated with dispatching a fully equipped mobile service vehicle are recovered, minimum charges apply to certain services.
Unless otherwise agreed:
On-site servicing is subject to a minimum labour charge.
Breakdown attendance is subject to a minimum call-out period.
Workshop repairs are subject to a minimum one-hour labour charge.
Diagnostic work is chargeable regardless of whether repairs proceed.
Minimum charges apply even if:
the fault cannot immediately be located;
replacement parts are unavailable;
repairs are declined after diagnosis;
the equipment is deemed beyond economical repair; or
the repair cannot be completed due to circumstances outside DDM’s control.
8. Travel Charges
As a mobile service provider, travel is chargeable for attendance at customer sites.
Travel charges cover:
travel time;
vehicle operating costs;
fuel;
maintenance;
specialised tooling transported within the service vehicle.
Travel charges will be disclosed within the quotation or invoice.
Where extended travel is required outside DDM’s normal operating area, additional mobilisation costs may apply. These costs will be discussed with the customer before work commences wherever reasonably practicable.
9. Breakdown Services
DDM provides breakdown support on a best-effort basis.
While every reasonable effort will be made to respond promptly, attendance times cannot be guaranteed due to factors including:
existing customer commitments;
traffic conditions;
weather events;
parts availability;
technician availability;
site access requirements.
Breakdown work is prioritised based on:
safety risk;
operational impact;
customer location;
availability of replacement parts.
A breakdown attendance fee and minimum labour charge may apply in accordance with DDM’s current pricing schedule.
10. After-Hours, Weekend & Public Holiday Work
Where work is requested outside DDM’s standard operating hours, additional labour rates may apply.
This includes:
evenings;
overnight breakdowns;
weekends;
public holidays;
urgent call-outs requiring immediate attendance.
Any applicable surcharge will be communicated before work commences wherever practical.
11. Remote & Regional Work
Projects located outside DDM’s standard service area may incur additional charges including, but not limited to:
extended travel;
accommodation;
meals;
mobilisation and demobilisation costs;
freight;
remote area allowances.
These costs will be discussed with the customer before work is undertaken and will form part of the quotation where applicable.
DDM reserves the right to decline remote work where safe access, suitable accommodation, required parts, or logistical support cannot be reasonably provided.
12. Parts & Materials
Unless otherwise agreed in writing, all replacement parts and materials used during repairs will be supplied by DDM.
Parts are sourced from reputable suppliers to ensure quality, reliability and warranty support.
Where a requested part is unavailable, DDM may recommend an equivalent product of equal or greater quality after consulting with the customer where practical.
The customer acknowledges that parts pricing may include reasonable handling, freight and procurement costs.
13. Customer-Supplied Parts
DDM may, at its sole discretion, agree to install parts supplied by the customer.
Where customer-supplied parts are used:
DDM provides no warranty on the supplied parts.
DDM accepts no responsibility for incorrect, incompatible or defective parts.
Any additional labour required due to faulty, incorrect or unsuitable customer-supplied parts will be charged at the applicable labour rate.
If replacement of a customer-supplied part is required, all associated labour, travel and material costs remain the responsibility of the customer.
DDM reserves the right to refuse installation of customer-supplied parts where quality, suitability or safety cannot be reasonably verified.
14. Special Order Parts & Deposits
Certain repairs require parts that are specifically ordered for a customer’s equipment.
For these jobs, DDM may require:
full payment for parts before ordering;
a deposit before commencing work; or
staged payments for larger repairs or projects.
Special-order parts cannot normally be returned once ordered.
Where a supplier charges a cancellation or restocking fee, this cost will be passed on to the customer.
Deposits are applied toward the final invoice and are generally non-refundable once parts have been ordered or work has commenced.
15. Additional Repairs
Mechanical inspections and repairs may identify additional faults that were not visible or reasonably detectable during the initial assessment.
Where practical, DDM will contact the customer to explain:
the additional fault;
the recommended repair;
the estimated cost; and
any effect on completion time.
No additional chargeable work will be undertaken without customer approval unless immediate action is reasonably necessary to prevent:
injury;
environmental harm;
significant equipment damage; or
an unsafe condition.
Approval may be provided by phone, SMS, email, ServiceM8 or any other written communication.
16. Ownership of Replaced Components
Unless requested before completion of the repair, all replaced components become the property of DDM and may be retained for warranty assessment, supplier return or environmentally responsible disposal.
If the customer wishes to retain replaced components, this request should be made before repairs are completed.
Certain warranty claims require defective parts to be returned to the manufacturer or supplier and, in these circumstances, DDM may not be able to release the replaced component to the customer.
17. Environmental Responsibilities
DDM is committed to responsible environmental practices.
Where applicable, waste materials including oils, filters, coolants, batteries and other regulated waste products will be disposed of in accordance with applicable environmental requirements.
Customers requesting disposal of contaminated fluids, hazardous materials or large quantities of waste generated outside the scope of the repair may incur additional disposal charges.
18. Delays Beyond Our Control
DDM will make every reasonable effort to complete repairs within the estimated timeframe.
However, delays may occur due to circumstances outside our reasonable control, including but not limited to:
supplier delays;
freight disruptions;
manufacturer backorders;
severe weather;
road closures;
site access restrictions;
industrial action;
power outages; or
other unforeseen events.
DDM will keep customers informed of significant delays and provide updated timeframes where reasonably possible.
DDM is not liable for any loss, downtime or consequential costs resulting from delays outside its reasonable control.
19. Payment Terms
Unless otherwise agreed in writing, payment is due upon completion of the work and receipt of the invoice.
Approved account customers may be offered alternative payment terms as agreed in writing.
Invoices are issued electronically through ServiceM8 and are payable using the payment methods specified on the invoice.
The customer is responsible for ensuring payment is made by the due date.
Failure to receive an invoice does not relieve the customer of their obligation to pay for completed work.
20. Overdue Accounts
Where an invoice remains unpaid after the due date, DDM may, at its discretion:
issue payment reminders;
suspend any future bookings or work;
withhold warranty consideration until the account is brought up to date (where permitted by law);
require full payment in advance for future work; or
refer the outstanding account to a debt recovery agency or legal representative.
The customer agrees to pay any reasonable costs incurred by DDM in recovering overdue amounts where permitted by law.
21. Deposits & Progress Payments
DDM may require a deposit before commencing work where:
high-value parts are required;
special-order components are being purchased;
major repairs are being undertaken;
extended on-site work is scheduled; or
significant labour or travel costs will be incurred before completion.
For larger projects, DDM may issue progress invoices at agreed milestones.
Failure to pay a required deposit or progress payment may result in delays or suspension of work until payment has been received.
22. Cancellation & Rescheduling
Customers are encouraged to provide as much notice as possible if a booking needs to be cancelled or rescheduled.
Where a technician has already been scheduled, dispatched, or parts have been ordered, cancellation charges may apply.
These charges may include:
travel already undertaken;
labour already performed;
ordered parts or materials;
supplier cancellation or restocking fees; and
any other reasonable costs incurred before cancellation.
Where possible, DDM will work with customers to reschedule appointments rather than cancel them.
23. Failure to Provide Access
Customers are responsible for ensuring that the technician has safe and reasonable access to the equipment at the agreed appointment time.
If work cannot proceed because:
the equipment is unavailable;
site access is denied;
required permits have not been arranged;
another contractor prevents access; or
the customer is not present where attendance is required,
DDM reserves the right to charge reasonable travel, labour and waiting time incurred as a result.
24. Suspension of Services
DDM reserves the right to suspend or refuse further work where:
invoices remain unpaid;
unsafe working conditions exist;
abusive or threatening behaviour is directed toward staff or contractors;
required deposits have not been paid;
legal or regulatory obligations prevent the work from proceeding; or
continuing the work would place DDM, its personnel or the customer’s equipment at unreasonable risk.
Where practical, customers will be advised of the reason for the suspension and any steps required before work can recommence.
25. Pricing Reviews
DDM periodically reviews its pricing to reflect changes in operating costs, supplier pricing, wages and market conditions.
Current labour rates, travel charges and applicable fees are available upon request and will be confirmed within quotations or estimates before work is undertaken wherever reasonably practicable.
Unless otherwise agreed, pricing applicable at the time the work is performed will apply.
26. Workmanship Warranty
DDM takes pride in delivering high-quality workmanship on every repair.
Subject to these Terms & Conditions, DDM provides a workmanship warranty covering defects that arise solely as a direct result of the workmanship performed by DDM.
Where a valid workmanship claim is accepted, DDM will, at its discretion:
inspect the reported issue;
repair the defect;
rectify the workmanship; or
provide another appropriate remedy consistent with Australian Consumer Law.
Warranty claims must be reported to DDM as soon as reasonably practicable after the issue is identified.
The customer must provide DDM with a reasonable opportunity to inspect the equipment before repairs are carried out by another party.
Repairs undertaken by another repairer without prior approval from DDM may affect the customer’s ability to claim under this workmanship warranty.
27. Parts Warranty
Replacement parts supplied by DDM are covered by the warranty provided by the original manufacturer or supplier.
Warranty periods and conditions vary between manufacturers.
Where a part is believed to be defective, DDM will assist the customer by managing the warranty claim with the supplier where reasonably possible.
Approval of manufacturer warranty claims remains at the discretion of the manufacturer or supplier.
DDM is not responsible for decisions made by manufacturers regarding warranty acceptance or rejection.
Labour associated with warranty replacement may not be covered unless specifically approved by the manufacturer.
28. Warranty Exclusions
To the extent permitted by law, DDM’s workmanship warranty does not apply where failures result from circumstances outside DDM’s reasonable control, including but not limited to:
normal wear and tear;
misuse or abuse;
lack of maintenance;
overloading;
accidents or collisions;
contamination of fuel, oil, coolant or hydraulic systems;
corrosion;
environmental conditions;
customer-supplied parts;
modifications performed by others;
unauthorised repairs;
continued operation after a fault has been identified or repair advice has been provided.
These exclusions do not affect any rights the customer has under Australian Consumer Law.
29. Australian Consumer Law
Nothing contained within these Terms & Conditions excludes, restricts or modifies any rights or remedies that cannot legally be excluded under the Australian Consumer Law or any other applicable legislation.
Where goods or services supplied by DDM are subject to statutory consumer guarantees, customers are entitled to the remedies provided by law.
Any limitations contained within these Terms apply only to the extent permitted by law.
30. Limitation of Liability
To the maximum extent permitted by law, DDM’s liability arising from the supply of goods or services is limited to the remedies available under Australian Consumer Law.
DDM is not responsible for indirect or consequential losses including, but not limited to:
loss of income;
business interruption;
loss of production;
hire costs;
loss of contracts;
downtime;
loss of profits; or
secondary damage arising from equipment being unavailable for use,
except where liability cannot legally be excluded.
31. Customer Responsibilities
The customer agrees to:
provide accurate information regarding the reported fault;
ensure equipment is safe to inspect and repair;
provide reasonable access to the equipment;
disclose known defects that may affect repairs;
follow any operating or maintenance recommendations provided by DDM following completion of the work.
Failure to meet these responsibilities may affect warranty claims where the customer’s actions have contributed to the failure.
32. Warranty Claim Procedure
If a customer believes a warranty claim exists, they should contact DDM as soon as reasonably practicable.
Customers should provide:
invoice number;
equipment details;
description of the issue;
photographs where available; and
details of any changes made since the original repair.
DDM will assess the claim promptly and communicate the proposed resolution as soon as reasonably practicable.
Our objective is to resolve genuine warranty issues fairly, professionally and with minimal disruption to our customers.
33. Safety & Site Requirements
The safety of our customers, employees, contractors and the public is DDM’s highest priority.
Customers are responsible for providing a safe working environment before work commences.
Where applicable, customers must ensure:
Safe access to the equipment.
Adequate lighting.
A stable and suitable work area.
Compliance with all applicable workplace health and safety requirements.
Isolation of equipment where required.
Identification of known hazards.
Site inductions, permits and access requirements are arranged before attendance.
DDM reserves the right to refuse or suspend work where unsafe conditions exist or where work cannot be performed safely.
Where attendance has already occurred, reasonable charges for travel, labour and waiting time may still apply.
34. Service Reports & Documentation
To maintain accurate service records and support future maintenance, DDM may provide digital job documentation following completion of the work.
Service documentation may include:
Service reports.
Photographs.
Parts installed.
Labour performed.
Fault descriptions.
Recommendations for future maintenance or repairs.
These reports form part of DDM’s quality assurance process and may be retained for warranty, compliance and service history purposes.
35. Privacy
DDM respects the privacy of its customers and is committed to handling personal information responsibly.
Information collected may include:
Customer contact details.
Business information.
Equipment information.
Service history.
Invoices and payment records.
Photographs taken during repairs.
This information is collected solely for the purpose of:
Providing requested services.
Preparing quotations and invoices.
Maintaining service history.
Processing warranty claims.
Meeting legal and regulatory obligations.
DDM will not sell or knowingly disclose customer information to third parties except where required by law or where necessary to perform the requested services.
Reasonable steps are taken to protect customer information from unauthorised access or disclosure.
36. Intellectual Property
Unless otherwise agreed in writing, all quotations, service reports, photographs, maintenance records, documents, recommendations and other materials prepared by DDM remain the intellectual property of Dunwoodie Diesel & Mechanical.
Customers may use these documents for the operation and maintenance of their own equipment but may not reproduce, modify or distribute them for commercial purposes without prior written consent.
37. Force Majeure
DDM will not be liable for any delay or failure to perform its obligations where such delay or failure results from circumstances beyond its reasonable control.
These circumstances may include, but are not limited to:
Severe weather events.
Natural disasters.
Bushfires.
Flooding.
Industrial action.
Supplier shortages.
Freight delays.
Government restrictions.
Power outages.
Equipment failure.
Illness or injury.
DDM will make reasonable efforts to minimise the impact of these events and keep customers informed where practical.
38. Changes to These Terms
DDM may amend these Terms & Conditions from time to time to reflect changes in legislation, business operations or industry practices.
The most current version will always be available on our website.
Terms applicable to a particular job will generally be those in effect when the quotation or booking was accepted.
39. Governing Law
These Terms & Conditions are governed by the laws of Western Australia.
Any dispute arising from services provided by DDM will be subject to the jurisdiction of the courts of Western Australia.
40. Acceptance of These Terms
By requesting a quotation, booking a service, approving repair work, accepting an estimate, or otherwise engaging Dunwoodie Diesel & Mechanical to perform work, the customer acknowledges that they have read, understood and accepted these Terms & Conditions.
Acceptance may occur through:
Approval within ServiceM8.
Acceptance of a written quotation.
Email confirmation.
SMS or written message.
Verbal instruction to proceed.
Requesting DDM to attend and perform services.
